第1条（適用）
本利用規約（以下「本規約」といいます）は、shuwa-lab（以下「当方」といいます）が提供するモバイルアプリケーション「ヤクセル」（以下「本アプリ」といいます）の利用条件を定めるものです。
ユーザーは、本アプリを利用することにより、本規約に同意したものとみなされます。本規約に同意いただけない場合は、本アプリをご利用いただけません。
第2条（定義）
「本サービス」とは、本アプリおよび本アプリに付随して当方が提供する一切の機能・サービスをいいます。
「ユーザー」とは、本規約に同意のうえ本サービスを利用するすべての方をいいます。
「翻訳キーボード」とは、本アプリが提供するiOSのカスタムキーボード拡張機能をいいます。
第3条（利用）
本サービスはアカウント登録なしの匿名認証でご利用いただけます。
未成年者が本サービスを利用する場合は、親権者など法定代理人の同意を得たうえでご利用ください。
ユーザーは、自己の責任において本サービスを利用するものとします。
第4条（サービス内容）
本サービスは、マイク音声や入力されたテキストをもとにリアルタイムで音声認識・翻訳を行う機能を提供します。
翻訳キーボードを用いることで、他のアプリの入力欄やコピーしたテキストを翻訳できます。
音声認識・翻訳には、Apple の端末内処理に加え、海外（米国を含む）の外部事業者や Google Firebase 等の第三者サービスを利用します。詳細はプライバシーポリシーをご確認ください。
第5条（料金・課金）
本サービスは、無料利用枠（一定時間・回数までの無料利用）に加えて、有料プランを提供します。現在の有料プランは以下のとおりです。
- Yaccel Pro：月額 500円（自動更新サブスクリプション）
- Yaccel Pro Plus：月額 980円（自動更新サブスクリプション）
有料プランは Apple の App内課金として提供されます。お支払いは、購入確定時にユーザーの Apple ID アカウントに請求されます。
サブスクリプションは、現在の期間が終了する24時間以上前に自動更新をオフにしない限り、自動的に更新され、同額が請求されます。更新の請求は、現在の期間が終了する24時間前以内に行われます。
サブスクリプションの管理および自動更新の解約は、購入後に App Store のアカウント設定からいつでも行えます。料金・課金タイミング・更新・解約の詳細は、購入時に App Store 上で表示される内容および Apple の定めに従います。
有料プランの価格・内容は、本規約および App Store 上の表示に従って変更される場合があります。なお、有料プランの提供に関し、特定商取引法その他の法令に基づき、事業者の氏名・住所等を別途表示します。
第6条（翻訳結果に関する免責）
本サービスが提供する音声認識・翻訳の結果は、その正確性、完全性、特定目的への適合性を保証するものではありません。
ユーザーは、医療、法務、契約、緊急時その他の重要な場面においては、翻訳結果のみに依拠せず、専門家への確認等の適切な手段を併用するものとします。
翻訳結果の利用によって生じたいかなる損害についても、当方は責任を負いません。
第7条（禁止事項）
ユーザーは、本サービスの利用にあたり、次の行為をしてはなりません。
・法令または公序良俗に違反する行為
・他者の権利（知的財産権、プライバシー権、肖像権等）を侵害する行為
・本サービスの運営を妨害し、または不正にアクセスする行為
・本サービスを逆コンパイル・リバースエンジニアリングする行為、利用上限を不正に回避する行為
・第三者になりすます行為、その他当方が不適切と判断する行為
第8条（知的財産権）
本アプリおよび本サービスに関する著作権、商標権その他の知的財産権は、当方または正当な権利者に帰属します。
ユーザーは、当方の事前の許諾なく、これらを複製、転用、改変等してはなりません。
第9条（ユーザーコンテンツ）
ユーザーが入力した音声・テキスト、および翻訳結果や会話履歴（以下「ユーザーコンテンツ」といいます）に関する権利はユーザーに帰属します。
会話履歴は原則として端末内に保存され、設定により一定時間経過後に自動削除し、または手動で削除できます。
当方は、本サービスの提供・改善に必要な範囲で、プライバシーポリシーに従いユーザーコンテンツを取り扱います。
第10条（第三者サービスの規約遵守）
本サービスは、音声認識・機械翻訳を提供する海外（米国を含む）の外部事業者のほか、Apple、Google 等の第三者サービスを利用しています。
ユーザーは、本サービスの利用にあたり、これら第三者の利用規約・ポリシーにも従うものとします。
第11条（サービスの変更・中断・終了）
当方は、ユーザーへの事前通知なく、本サービスの内容を変更し、または提供を中断・終了することがあります。
これによりユーザーに生じた損害について、当方は責任を負いません。
第12条（免責・責任の制限）
本サービスは現状有姿で提供され、当方は本サービスに事実上または法律上の瑕疵がないことを保証しません。
当方は、本サービスの利用に関連してユーザーに生じた損害について、当方の故意または重過失による場合を除き、責任を負いません。
法令上、責任の全部または一部を免責できない場合、当方の責任は適用される法令で認められる範囲に限定されます。
第13条（本規約の変更）
当方は、必要に応じて本規約を変更することがあります。
変更後の本規約は、本アプリ内または本サイトに表示した時点から効力を生じるものとします。重要な変更については適切な方法で周知します。
第14条（準拠法・管轄）
本規約の解釈および適用は、日本法に準拠します。
本サービスに関して当方とユーザーとの間に紛争が生じた場合には、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

1. Application
These Terms of Service (the "Terms") govern your use of the mobile application "Yaccel" (the "App") provided by shuwa-lab (the "Provider").
By using the App, you are deemed to have agreed to these Terms. If you do not agree, you may not use the App.
2. Definitions
"Service" means the App and all features and services provided by the Provider in connection with the App.
"User" means any person who uses the Service in accordance with these Terms.
"Translation Keyboard" means the custom iOS keyboard extension provided by the App.
3. Use of the Service
The Service can be used through anonymous authentication without account registration.
If a minor uses the Service, they must do so with the consent of a parent or legal guardian.
Users use the Service at their own responsibility.
4. The Service
The Service provides real-time speech recognition and translation based on microphone audio and entered text.
Using the Translation Keyboard, you can translate text in other apps' input fields or copied text.
Speech recognition and translation use on-device processing by Apple as well as third-party services, including overseas providers (located in countries such as the United States) and Google Firebase. Please see the Privacy Policy for details.
5. Fees and Billing
In addition to a free usage allowance (free use up to a certain time or number of uses), the Service offers paid plans. The current paid plans are as follows:
- Yaccel Pro: 500 yen per month (auto-renewing subscription)
- Yaccel Pro Plus: 980 yen per month (auto-renewing subscription)
Paid plans are offered through Apple in-app purchases. Payment will be charged to your Apple ID account upon confirmation of purchase.
A subscription automatically renews and is charged at the same price unless auto-renewal is turned off at least 24 hours before the end of the current period. The renewal charge is made within 24 hours prior to the end of the current period.
You can manage your subscription and turn off auto-renewal at any time after purchase through your App Store account settings. Prices, billing timing, and renewal/cancellation details are subject to the information shown on the App Store at the time of purchase and to Apple's rules.
Prices and contents of paid plans may change in accordance with these Terms and the information shown on the App Store. The Provider discloses the business operator's name, address, and other information regarding paid plans separately, as required by applicable law (such as Japan's Act on Specified Commercial Transactions).
6. Disclaimer Regarding Translation
The results of speech recognition and translation provided by the Service are not guaranteed to be accurate, complete, or fit for a particular purpose.
In important situations such as medical, legal, contractual, or emergency contexts, Users should not rely on translation results alone and should use appropriate additional means, such as consulting a professional.
The Provider is not liable for any damages arising from the use of translation results.
7. Prohibited Conduct
When using the Service, Users must not engage in any of the following:
・Acts that violate laws or public order and morals
・Acts that infringe the rights of others (intellectual property rights, privacy, portrait rights, etc.)
・Acts that interfere with the operation of the Service or that involve unauthorized access
・Decompiling or reverse engineering the Service, or improperly circumventing usage limits
・Impersonating a third party, or other acts the Provider deems inappropriate
8. Intellectual Property
Copyrights, trademarks, and other intellectual property rights relating to the App and the Service belong to the Provider or other rightful owners.
Users may not reproduce, repurpose, or modify them without the Provider's prior consent.
9. User Content
Rights to the audio and text entered by Users, as well as translation results and conversation history (collectively, "User Content"), belong to the User.
Conversation history is, in principle, stored on the device and can be automatically deleted after a set period or deleted manually, depending on your settings.
The Provider handles User Content in accordance with the Privacy Policy to the extent necessary to provide and improve the Service.
10. Compliance with Third-Party Terms
The Service uses third-party services, including overseas providers (located in countries such as the United States) of speech recognition and machine translation, as well as Apple and Google.
When using the Service, Users must also comply with the terms and policies of these third parties.
11. Changes, Suspension, and Termination of the Service
The Provider may change the content of the Service or suspend or terminate it without prior notice to Users.
The Provider is not liable for any damages incurred by Users as a result.
12. Disclaimer and Limitation of Liability
The Service is provided "as is," and the Provider does not warrant that it is free from factual or legal defects.
Except in cases of the Provider's willful misconduct or gross negligence, the Provider is not liable for damages incurred by Users in connection with the use of the Service.
Where liability cannot be excluded in whole or in part under applicable law, the Provider's liability is limited to the extent permitted by such law.
13. Changes to These Terms
The Provider may revise these Terms as necessary.
The revised Terms take effect when displayed within the App or on this site. Significant changes will be communicated by appropriate means.
14. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of Japan.
In the event of a dispute between the Provider and a User concerning the Service, the Tokyo District Court shall be the court of exclusive jurisdiction of the first instance.
